General Terms and Conditions

1. Scope and Definitions

1.1. These General Terms and Conditions (“Terms”) govern (a) all online sales of artworks, limited editions, prints, and books (the “Products”) via the website www.vue-gallery.com (the “Website”) operated by CH Real Estate SRL under the name “Vue Gallery” (“Vue Gallery”, “we”, “us”), and (b) the use of the Website by any visitor or customer (“User”, “Customer”, “you”).

1.2. By accessing the Website or placing an order, you acknowledge that you have read, understood and agreed to be bound by these Terms.

3. Website Use

3.1. Access and Availability

We aim to keep the Website accessible at all times, but access may be suspended temporarily for maintenance, updates or technical reasons.

We shall not be liable for any unavailability or for any damage resulting from interruptions.

3.2. User Obligations

Users agree not to:

(a) use the Website for fraudulent or unlawful purposes;

(b) attempt to gain unauthorised access to the Website, its servers or data;

(c) introduce viruses, malware or any other harmful code;

(d) interfere with or disrupt the proper functioning of the Website;

(e) scrape, copy or systematically extract Website content without prior written consent.

3.3. Accounts (if applicable)

If the Website allows the creation of customer accounts, you are responsible for keeping your credentials confidential and for all activities under your account.

You must inform us promptly of any suspected unauthorised use.

4. Products and Presentation

4.1. Many artworks and editions are unique or available in limited runs. All offers are subject to availability.

4.2. We take care to present Products on the Website with accurate images and descriptions. However, due to the nature of artworks and display settings, minor variations in colour, texture or appearance may occur. Such variations do not constitute a lack of conformity.

5. Prices

5.1. Prices are indicated in euros (EUR) and include Belgian VAT where applicable, unless otherwise stated.

5.2. Shipping, insurance and any customs or import duties (for deliveries outside the EU) are not included in the Product price unless expressly mentioned. These costs are shown separately before you confirm your order.

5.3. We may change prices at any time, but the applicable price is the one in force at the time your order is placed.

6. Orders and Contract Formation

6.1. The ordering process on the Website generally comprises the following steps: selection of Products, validation of the basket, entry of personal and delivery data, choice of delivery and payment method, and final confirmation of the order.

6.2. Before final confirmation, you can verify and correct your order details.

6.3. The contract (the sale) is formed once payment has been successfully completed and you receive an order confirmation email.

6.4. We reserve the right to refuse or cancel an order in case of:

(a) unavailability of the Product;

(b) obvious pricing or product description errors;

(c) suspicion of fraud or non-payment risk;

(d) legal or regulatory restrictions affecting the sale or export of the Product.

7. Payment

7.1. Payments are processed through secure payment providers, including Squarespace Payments and/or Stripe.

7.2. Vue Gallery does not store or have access to your full payment card details.

7.3. In case of non-payment, fraud or payment irregularity, we are entitled to cancel the order.

8. Delivery and Risk Transfer

8.1. Products are delivered to the delivery address indicated during the ordering process.

8.2. Delivery times depend on the destination, the nature of the Product and the selected delivery method. Original artworks may require specific packaging, handling and insurance.

8.3. Risk of loss or damage passes to you upon physical delivery of the Products.

8.4. Upon delivery, you should inspect the condition of the parcel and the Products. In case of damage or missing items, you must notify the carrier immediately and inform Vue Gallery within 48 hours.

9. Right of Withdrawal (Consumers Only)

9.1. If you are a consumer residing in the EU, you generally have a right to withdraw from the online purchase within 14 days from the day of delivery, without giving any reason, subject to the exceptions below.

9.2. The right of withdrawal does **not** apply to:

(a) bespoke, commissioned or clearly personalised artworks;

(b) original artworks which, by their nature, are likely to be damaged if returned or cannot be returned under normal postal conditions;

(c) sealed books or publications which have been unsealed after delivery.

9.3. To exercise the right of withdrawal, you must send us a clear written statement within 14 days after delivery, by email to charly@vue.com, indicating your decision to withdraw and referencing your order number.

9.4. You must return the Products in their original condition and packaging, using appropriate protective materials. Return costs and insurance are at your expense, unless otherwise agreed.

9.5. We will refund the amounts received for the Product (excluding return costs and any customs charges) within 14 days from receipt of the returned Products or from the receipt of proof of shipment, whichever occurs first.

10. Conformity and Complaints

10.1. We are liable for any lack of conformity existing at the time of delivery in accordance with applicable Belgian consumer law.

10.2. Any complaint regarding visible defects or non-conformity must be notified in writing within a reasonable time after discovery and at the latest within 14 days after delivery.

10.3. In the event of a justified complaint, we may, at our discretion, repair the Product, replace it, or refund the purchase price (in whole or in part).

11. Intellectual Property in Artworks and Content

11.1. All artworks, photographs, prints, texts, designs and other content sold or displayed by Vue Gallery are protected by copyright and other intellectual property rights.

11.2. The purchase of a physical artwork or book does not grant you any reproduction, representation, distribution or adaptation rights. Any use beyond private, domestic use requires prior written approval from the rights holder.

11.3. Certificates of authenticity, where provided, confirm the authorship and/or edition of the work but do not constitute a transfer of intellectual property rights.

12. Liability

12.1. We are not liable for non-performance or delay in performance due to force majeure or events beyond our reasonable control, including but not limited to strikes, transport interruptions, natural disasters, pandemics, or actions of public authorities.

12.2. We shall not be liable for any indirect or consequential damages, such as loss of opportunity, loss of profits, or loss of image.

12.3. For consumer Customers, any limitation of liability applies only to the extent permitted by mandatory Belgian consumer law.

13. Personal Data

13.1. The processing of personal data in the context of orders, newsletter subscriptions, Website use and security is described in detail in our Privacy Notice.

13.2. By placing an order or using the Website, you acknowledge that you have read the Privacy Notice.

14. Applicable Law and Jurisdiction

14.1. These Terms and any dispute arising from or relating to them, to the use of the Website or to any sale made via the Website are governed by Belgian law.

14.2. In case of dispute, we will seek an amicable solution first. Consumers may use the European Online Dispute Resolution (ODR) platform.

14.3. Failing amicable settlement, disputes shall be brought before the competent courts of the registered office of CH Real Estate SRL (Brussels, French-speaking division), without prejudice to mandatory consumer jurisdiction rules.

15. Amendments to the Terms

15.1. Vue Gallery may amend these Terms at any time, in particular to reflect legal or technical developments.

15.2. The version applicable to your order is the version in force on the date you placed the order.
